The aim of this research whose title is “Towards a mature laicality” is to give a contribution to the “assertion” of the notion of laicality which has been prevailing since long time, the danger of its disgraceful loss of semantic meaning as well as a blameworthy death for inanition. To do that, there has been a revaluation of its contents (distinction of orders, freedom of conscience and equality) and distinctive features (relative/dynamic, positive and open) drawing, at the same time, on the most significant contributions, both doctrinal and jurisprudential, on the subject. In order to do that, both the complex secular-state prospective and the ecclesiastic one have been taken into consideration thus becoming aware of the existence of confessional germs with the worldly determination of this notion (for example you may think about the etymological origin) and of secular traces but not of secularization on its canonistic-theological representation: in primis the establishment of mutual autonomy and independence between earthly civitas and heavenly civitas. The results of such research have given the opportunity to realize that both Church and State though starting from different assumptions which are apparently and ontologically incompatible and though making use of distinct procedures, they are coming along converging lines and with synoptic stages towards a common end: the fosterage of man

Nell'ambito del presente progetto di ricerca, dal titolo "Verso una laicità matura", si è tentato di fornire un contributo all'inveramento della nozione di laicità, imperante, ormai da tempo, il pericolo di una sua deprecabile desemantizzazione, nonchè di una, altrettanto riprovevole, morte per inanizione, procedendo a una rivisitazione dei suoi contenuti (distinzione degli ordini, libertà di coscienza e uguaglianza) e connotati essenziali (relativa/dinamica, positiva e aperta) e, al contempo, attingendo dai più significativi contributi in materia, sia dottrinali che giurisprudenziali. Nel far ciò si è vagliata e la complessa prospettiva secolar-statuale e quella ecclesiale, prendendo coscienza della sussistenza di germi di confessionale nella determinazione mondana di detta nozione e di tracce secolari nella rappresentazione teologico-canonistica. Confrontate le risultanze di detta indagine, si è rilevato come le due entità (Stato e Chiesa) pur partendo, in materia di laicità, da presupposti di primo acchito ontologicamente inconciliabili e pur usufruendo di processi assai distanti, stiano procedendo in maniera convergente e con tappe sinottiche verso un fine comune: la promozione dell'uomo

Abstract

Nell'ambito del presente progetto di ricerca, dal titolo "Verso una laicità matura", si è tentato di fornire un contributo all'inveramento della nozione di laicità, imperante, ormai da tempo, il pericolo di una sua deprecabile desemantizzazione, nonchè di una, altrettanto riprovevole, morte per inanizione, procedendo a una rivisitazione dei suoi contenuti (distinzione degli ordini, libertà di coscienza e uguaglianza) e connotati essenziali (relativa/dinamica, positiva e aperta) e, al contempo, attingendo dai più significativi contributi in materia, sia dottrinali che giurisprudenziali. Nel far ciò si è vagliata e la complessa prospettiva secolar-statuale e quella ecclesiale, prendendo coscienza della sussistenza di germi di confessionale nella determinazione mondana di detta nozione e di tracce secolari nella rappresentazione teologico-canonistica.
