This research work deals with the phenomenon of territorial changes of Regions ex art. 132, paragraph 2, of the Constitution. These changes represent an old and a new matter at the same time: the former because the possibility of a regional body modification was provided for by the Constitution; the latter because until a few years ago no territorial variation procedure had ever been carried out. This is probably one of the reasons why the doctrine has never paid attention to this constitutional norm, leaving it relegated to “grey areas” of the system, where its validity has coexisted with its concrete inability to be carried out. This situation has changed since May 2005, when the Municipality of San Michele in Tagliamento (Province of Venice), for the first time in Italy, celebrated the Referendum for the detachment from the Veneto Region and its aggregation to the Friuli Venezia Giulia one. Since then, the doctrine began to be involved in this issue, with detailed interventions dealing with the territorial variation procedure. Constitutional jurisprudence also began to be involved in the first questions about this matter and it has produced three important judgements: the 334/2004 judgement, the 66/2007 judgement and the 246/2010 judgement. It is known that the activation of procedures to change the regional membership depends on the occurrence of 3 assumptions: 1) that the regional division is inadequate to economic, political, social and cultural reality of the country; 2) that the inadequacy can be removed through the modification of regional constituencies; 3) that the proceedings are suitable to support that modification. The first part of the research aims to provide a response to these 3 points. After the first paragraphs in a historical tone, designed to highlight how the changing phenomenon has not been absent from the Italian legal tradition, being already contemplated in the Albertine Statute although only for the change of territorial constituencies of Municipalities and Provinces, the work focuses on the path that led to the approval, in the Constituent Assembly, of article 132, paragraph 2, Cost. in its first form (before the reform of Title V) and on the reasons connected to this choice by the Constituent. The analysis of the preliminary works, joined with the first applications of the spatial variation for the passage of Municipalities and Provinces from one Region to another, since the referendum in 2005, becomes useful to highlight as the same may not be sufficiently useful to an evolution in the “functional” sense of the Italian regional structure, owing to the limited extent of change that it is actually able to achieve. The continuation of the work, however, after having clarified the concept of the involved populations (and the problems related to it), whose consultation by Referendum becomes the main moment of the iter of modification, especially following the 18th October 2001 constitutional law, n. 3, analyzes the different institutes and moments that characterize the process: from the request to start the procedure dealt with the article 132, paragraph 2, Cost. by Municipalities and Provinces to the nature of the Referendum of spatial variation, from the role played by Regional Councils in the expression of their opinions about the contents and purposes of the law of modification. In particular, these are not exclusively considered in a theoretical or abstract perspective, but studied highlighting the application of the article 132, paragraph 2, Cost. In fact, this article has led to the coming out of a whole series of issues which the doctrine had never dealt with before. Let’s think, in particular, to the identification of a suitable source in case of detachment-aggregation of a Municipality or of a Province from an ordinary Region to a special one; to the legitimacy or the illegality of Referendums that engage more unitary councils rather than distinct for each local reality involved (as in the case of the Municipalities of the Upland of Asiago, Cortina d'Ampezzo, Colle Santa Lucia and Livinallongo-Col di Lana and the Municipalities of Alta Valmarecchia), to the content of the right of self-determination of local government that finds its maximum expression in the Referendum, to the bureaucratic-administrative problems raised by the first law implementing art. 132, n. 117/2009, concerning the detachment of the Municipalities of Alta Valmarecchia from the Marche Region (Province of Pesaro Urbino) and their aggregation to the Emilia Romagna Region (Province of Rimini).

La prima parte della ricerca cerca di fornire una risposta a questi tre aspetti. Dopo i primi paragrafi di taglio storico, volti a mettere in rilievo come il fenomeno variatorio non sia stato assente dalla tradizione giuridica italiana, essendo già contemplato nello Statuto Albertino anche se limitatamente al mutamento delle circoscrizioni territoriali di Comuni e Province, il lavoro si concentra sul percorso che ha condotto all’approvazione, in Assemblea Costituente, dell’art. 132, comma 2, Cost. nella sua formulazione ante riforma del Titolo V e sulle ragioni legate a questa scelta del Costituente. Proprio l’analisi dei lavori preparatori, congiunta alle prime modalità applicative del procedimento di variazione territoriale per il passaggio di Comuni e Province da una Regione ad un’altra a partire dai primi referendum del 2005, tende a mettere in rilievo come lo stesso non possa dirsi sufficiente utile per una evoluzione in senso “funzionale” dell’assetto regionale italiano, in ragione della limitata portata modificativa che esso, di fatto, è in grado di conseguire. Il proseguo del lavoro, invece, dopo aver preliminarmente chiarito il concetto di popolazioni interessate (e le problematiche ad esso connesse), la cui consultazione con referendum diventa il momento principale dell’iter di modificazione, soprattutto a seguito della legge costituzionale 18 ottobre 2001, n. 3, analizza i diversi istituti che caratterizzano il procedimento: dalla richiesta di avvio da parte di Comuni e Province alla natura del referendum di variazione territoriale, dal ruolo assunto dai Consigli regionali nell’espressione del parere ai contenuti ed alle finalità della legge di modificazione. In particolare, questi momenti non sono considerati in una prospettiva esclusivamente teorica ed astratta, ma studiati alla luce della prassi applicativa dell’art. 132, comma 2, Cost. Infatti, proprio questa prassi ha consentito di far emergere tutta una serie di problematiche sulle quali la dottrina non si era mai, fino ad ora, soffermata. Si pensi, in particolare, all’individuazione della fonte idonea in caso di distacco-aggregazione di un Comune o di una Provincia da una Regione ordinaria ad una Regione speciale, alla legittimità o meno di consultazioni referendarie unitarie ossia coinvolgenti più amministrazioni comunali anziché distinte per ciascuna realtà locale coinvolta (come nel caso dei Comuni dell’Altopiano di Asiago e dei Comuni di Cortina d’Ampezzo, Colle Santa Lucia e Livinallongo del Col di Lana), al contenuto del diritto di autodeterminazione delle collettività locali che trova la sua massima espressione nel referendum, ai problemi di ordine amministrativo-burocratico posti dalla prima legge di attuazione dell’art. 132, la n. 117/2009, relativa al distacco dei Comuni dell’Alta Valmarecchia dalla Regione Marche (Provincia di Pesaro-Urbino) alla Regione Emilia-Romagna (Provincia di Rimini).

Abstract

Il lavoro di ricerca ha per oggetto di studio il fenomeno delle variazioni territoriali delle Regioni ex art. 132, comma 2, della Costituzione.
