The thesis analyzes the position of corporate worker of cooperative, position resulting from the competition of corporate relationship with the employment relationship. From the two dealings connected descend those characters that characterize the particular specialty of the employment relationship employed by the cooperative society. The social worker, in fact, before being employed is a member of corporate, and therefore contributes to the management of the company, the formation of social capital, the formation of corporate bodies and participates in business risk, as well as to the economic results and decisions their destination. The legislature, by Law no. 142 of 2001 governs this position, surpassing the previous reconstruction of the figure that, in the absence of specific provisions, had brought the work performance, made by the member, to the fulfillment of social obligation, therefore, is not covered by the area of the labor law. The new law has imposed, in addition to the social relationship, the establishment of an additional employment, as an employee, self-employment or in any other form. This employment relationship, however, is not completely subject to the rules that would result from establishing the type of contract chosen, where it was established in the absence of connected social relations, as the reform law has established that the effects of the rules of law, different from the Law no. 142, are applicable only to the extent compatible with the position of social worker. Just this screen compatibility determines that the regulation of labor relations established with the social worker differs from the classical one, thus ensuring compliance with the Constitution of a reform which extended the protection for the collaborative work, while at the same time equate the social worker to normal employee. The paper aims to analyze the special employment relationship in its various facets and at different times, from the establishment of relations to their extinction. Will thus analyzed the different types of employment contracts together with the corresponding discipline. Major deviations from the original scheme will be found in particular in the employment contract term and especially in coordinated and continuous collaboration for which the renewal project may not be applicable to the working partner. The special position of the working partner will then be emphasized: in the competition of worker-members in management; in the determination of remuneration; in the possible reduction of the salary to deal particular situations for the enterprise like beginning of the business or the crisis of company. But it is the time of extinction of the social relationship to be the main event of the specialty of the position in question since this act automatically determines the termination of the employment relationship. The risk is feared that the company can use the exclusion, instead of dismissal as a means of punishment for non-compliance relating to employment, resulting in failure to apply the legislation to protect the worker against a disciplinary dismissal. The paper covers the fields to analyze the means to bring the exclusion into its traditional channel through the systematic interpretation of the provisions of Law No. 142 and the reconstruction in terms of abuse of the right of exclusion used outside of the typical function that this measure is in company law. The research then examines other issues of concern relating to: the competition between the exclusion and dismissal for just cause, the termination of the employment relationship and continuity of social relationships and the resignation of a member of the employment relationship in the constancy of the social relationship

La tesi si occupa di analizzare la posizione del socio lavoratore di cooperativa, posizione risultante dal concorso del rapporto sociale con il rapporto di lavoro. Dalla duplicità dei rapporti collegati discendono quei caratteri che connotano di specialità il particolare rapporto di lavoro instaurato alle dipendenze della società cooperativa. Il socio lavoratore, infatti, prima di essere lavoratore è socio della società, e pertanto concorre alla gestione dell'impresa, alla formazione del capitale sociale, alla formazione degli organi sociali nonché partecipa al rischio di impresa, oltre che ai risultati economici ed alle decisioni sulla loro destinazione.
